User Agreement
1. General Provisions
- 1.1. These Terms govern the use of https://simroulette.com (the — “Site”) and regulate the relationship between the user (the — “User”) and the owner of the Site (the — “Company”).
- 1.2. By using the Site, including browsing its pages, the User acknowledges that they have read these Terms and unconditionally agree to them.
- 1.3. If the User does not agree with these Terms, they must immediately stop using the Site.
- 1.4. The Company may amend these Terms at any time. The updated version takes effect upon publication on the Site, unless stated otherwise.
- 1.5. Use of the Site is permitted only for persons aged 18 or older.
2. Company Information
- 2.1. The Company operates under the trademark Sim Roulette through the website https://simroulette.com.
- 2.2. The Company’s legal details (including legal name and address of the contracting entity) are provided to the User prior to contract conclusion and in the order confirmation, in compliance with applicable EU consumer information rules.
3. Scope
- 3.1. The Site enables the User to review products and services presented on the Site and to place a preliminary order.
- 3.2. The products and solutions presented on the Site may include, without limitation: SIM aggregators, electronic modules, software, and other communications hardware.
- 3.3. The Company is not responsible for any actions performed by the User using purchased products, including any use that may contravene applicable laws.
4. Ordering
- 4.1. Information on the Site is an invitation to treat. An order placed by the User constitutes an offer and is subject to the Company’s acceptance.
- 4.2. After an order is placed, a manager will contact the User to clarify terms and discuss details.
- 4.3. The contract is concluded at the order confirmation stage; full company details and payment information are provided prior to and/or at the time of contract conclusion.
- 4.4. The contract may be concluded in writing, electronically, or in any other form agreed by the parties, in accordance with applicable law.
5. Rights and Obligations
- 5.1. The Company undertakes to:
- Provide accurate information on product characteristics.
- Agree the key terms of sale with the User before the contract is concluded.
- The Company may refuse service if the User provides false information or where there are reasonable grounds to suspect a breach of applicable law.
- 5.2. The User undertakes to:
- Provide accurate contact details when submitting a request.
- Use the purchased equipment in compliance with the laws of their jurisdiction.
6. Use of SIM Aggregators
- 6.1. SIM aggregators presented on the Site are intended for lawful purposes, such as organizing and monitoring communications, automating business processes, and other legitimate data-exchange tasks.
- 6.2. The Company is not responsible for uses that may violate local telecommunications laws or the terms of mobile operators. The User is expressly warned against any unlawful use in the country where activities are conducted.
- 6.3. When using SIM aggregators, the User must comply with all applicable local laws and regulations, including but not limited to data protection rules, telecommunications security, anti-spam rules, and consent requirements. The User bears full responsibility for legal compliance.
7. Delivery
Products are dispatched only after the contract is concluded with the User and all terms are confirmed by the manager. Final company details and information are provided at contract conclusion and in the order confirmation.
8. Returns and Exchanges
- 8.1. Returns are accepted in accordance with applicable law if the product is defective or does not match the description.
- 8.2. Complex technical products may be returned only in the event of a manufacturing defect confirmed by qualified specialists, unless mandatory consumer protection rules provide otherwise.
- 8.3. The User must preserve completeness, packaging, and the commercial appearance of the product until it is handed over for return, subject to applicable law.
9. Liability
- 9.1. The Company shall not be liable for:
- Use of products for unlawful purposes.
- The User’s breach of law when operating the equipment.
- Damage caused to third parties as a result of the product’s use by the User.
- 9.2. The User is solely responsible for compliance with all laws governing the use of purchased products in their jurisdiction.
10. Final Provisions
- 10.1. Disputes shall be resolved through negotiations between the parties. If no agreement is reached, disputes are subject to the competent courts in the country of the Company’s establishment, without prejudice to any mandatory consumer protection rights and jurisdiction rules under applicable EU law.
11. Personal Data Processing (GDPR)
- 11.1. When submitting a request on the Site, the User may provide personal data such as their name, phone number, email address, and other details necessary for communication and contract performance. The Company applies the principles of lawfulness, fairness, transparency, data minimization, and purpose limitation under the GDPR.
- 11.2. Purposes and legal bases. The Company processes personal data to handle requests, conclude and perform contracts, provide support, and communicate with the User. The legal bases include: performance of a contract (Art. 6(1)(b) GDPR), legitimate interests (Art. 6(1)(f) GDPR; e.g., ensuring service security and responding to inquiries), and consent where applicable (Art. 6(1)(a) GDPR).
- 11.3. Data sharing and transfers. Personal data may be shared with service providers (processors) engaged under data processing agreements, and disclosed where required by law. International transfers outside the EEA, if any, are subject to appropriate safeguards (e.g., Standard Contractual Clauses) in accordance with GDPR.
- 11.4. Retention. Personal data are retained only for as long as necessary for the purposes set out above, or as required by applicable law. After the retention period expires, data are securely deleted or anonymized.
- 11.5. User rights. The User has the right to request access, rectification, erasure, restriction of processing, data portability, and to object to processing, as well as the right to withdraw consent at any time (where processing is based on consent). The User also has the right to lodge a complaint with a competent supervisory authority in the EEA.
